Terms of Service

1. Agreement

By accessing or using ARBEX you agree to be bound by these Terms and by our Privacy Policy and Refund & Cancellation Policy, which are incorporated here by reference. If you don't agree, please don't use the service. If you're signing up on behalf of a dealership, you confirm you have authority to bind that entity.

2. The service

ARBEX is an inventory acquisition intelligence platform: a software-as-a-service product that helps dealers decide which vehicles to buy, where, when, and at what price. It ingests public vehicle listings, scores each candidate for acquisition profit and risk, and surfaces the ones worth pursuing. Access to features and data depth is set by your plan (Starter, Pro, Max, or Enterprise), and some plans carry fair-use limits on states, sources, and saved searches to keep the service fast and available for everyone.

3. Eligibility

ARBEX is a business tool. You must be at least 18 years old and using the platform for a bona fide vehicle-dealing business. By using ARBEX you confirm you meet these requirements and that the information you register is accurate.

4. Your account

Keep your credentials safe. You're responsible for everything that happens under your account and for any seats you add. If you believe credentials were compromised, change your password immediately from Settings and let us know so we can help secure the account.

5. Acceptable use

• Don't scrape, mirror, or resell ARBEX data, scores, or routes to third parties who haven't paid for it.
• Don't reverse-engineer, decompile, or attempt to reconstruct the scoring engine, and don't try to bypass plan gates, rate limits, or security measures.
• Don't access accounts, rooftops, or data you don't own.
• Don't use the platform to break consumer-protection, lending, tax, title, or auction laws in your jurisdiction.

We may investigate suspected violations and suspend or block access to protect the service and other customers.

6. Your data

You keep ownership of the information you put into ARBEX — your dealership profile, filters, watchlists, and notes. You grant us a limited license to process that data solely to operate the service for you (authenticate you, run your searches, send the alerts you opt into). We do not sell your data, and we do not use it to train AI models. Full detail lives in our Privacy Policy.

7. Scores & output

ARBEX produces opportunity scores and grades, along with estimated net profit, ROI, landed cost, and route suggestions. You're free to use that output to run your business, but it is informational — a ranked starting point, not a recommendation to buy a specific vehicle (see §8 on the estimated figures). You remain responsible for independently verifying every vehicle (condition, title, history, actual costs) before committing capital, and for your own compliance with the laws that govern your purchases and resales.

8. Estimated figures — no guarantee of profit

ARBEX displays estimated figures — including net profit, an estimated-profit range (a conservative-to-optimistic band), ROI, landed cost, expected resale, a maximum safe buy price, and days-to-sell metrics. These are projections a model derives from assumptions (such as the destination-market median resale and estimated transport, tax, title, and reconditioning costs), generated with the help of AI models — not measured outcomes. They are estimates, not guarantees of profit, may be wrong for any individual vehicle, and your actual results will differ — sometimes materially — based on factors outside ARBEX's control: the vehicle's true condition and history, market movement, how long the unit takes to sell, your negotiation and financing, and your local costs.

The estimated-profit range shows a modeled spread of outcomes, not the minimum or maximum you will actually make. The maximum safe buy price is model-derived buying guidance — it is not an appraisal, a valuation, or an offer to buy, and it does not account for a specific vehicle's true condition. Always inspect the vehicle and verify comparable prices before you buy at any price.

Treat every figure as a starting estimate to verify, not a promise of a return. ARBEX is a decision-support tool — it is not investment, financial, tax, or legal advice, and ARBEX is not your broker, dealer, agent, or fiduciary. To the maximum extent permitted by law, ARBEX is not liable for any decision made, or capital committed, in reliance on these figures.

9. Third-party services

ARBEX relies on third parties to work, and their terms also apply where relevant: public vehicle-listing sources (dealer websites, marketplaces, and auction feeds), vehicle reference and NHTSA recall data, AI model providers (Anthropic) for AI-assisted scoring, and our payment processor (Stripe) for billing. Listing data originates with those sources, and we don't warrant its completeness or accuracy.

10. Billing & availability

Plans are billed monthly or annually as described on the pricing page. Trials, cancellations, pauses, and refunds are governed by our Refund & Cancellation Policy. We work to keep ARBEX available and current, but we may rate-limit, change, or discontinue features to improve or protect the service, and we don't guarantee uninterrupted or error-free operation.

11. Intellectual property

ARBEX owns the platform, its name and brand, the scoring engine, the derived scores and grades, and the site design and code. Your own data and content are yours and are excluded from that. Nothing here gives you a license to copy, modify, or redistribute ARBEX's intellectual property without our written permission.

12. Termination

You can cancel any time from Settings → Billing; access continues per your plan terms. We may suspend or terminate accounts that violate these Terms. Provisions that by their nature survive termination — disclaimers, liability limits, indemnity, and governing law — continue to apply.

13. Disclaimer of warranties

The service is provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose, title, and non-infringement. ARBEX does not warrant that the service will be uninterrupted, error-free, or secure, or that any score, estimate, or opportunity will be accurate or profitable.

14. Limitation of liability

To the maximum extent permitted by law, ARBEX is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising from your use of the service. Our total liability for any claim is capped at the fees you paid us in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions our liability is limited to the maximum extent permitted by law, and some of the above limitations may not apply to you.

15. Indemnity

You agree to indemnify ARBEX against claims, damages, liabilities, and reasonable expenses (including legal fees) arising from your use of the service or its output, your violation of these Terms, or your violation of any law or third-party right.

16. Governing law

These Terms are governed by the laws of the United States and of the state in which ARBEX's operating entity is established, without regard to conflict-of-law principles, and any disputes will be brought in the courts with jurisdiction over that location.

17. Changes

We may update these Terms. Material changes will be posted here with a new "Last updated" date and announced by email at least 30 days before they take effect. Your continued use of ARBEX after the effective date means you accept the revised Terms.
